Terms of Service

Welcome to AlwaysWager("AlwaysWager", "we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of the AlwaysWager website, applications, and services (collectively, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Nature of the Service

AlwaysWager is an informational and analytical platform. It uses artificial-intelligence models, statistical analysis, line movement tracking, and other data sources to generate commentary and suggestions about sporting events. AlwaysWager is not a sportsbook, does not accept wagers, does not hold customer funds, and does not facilitate the placement of bets with any third party.

Nothing we publish constitutes a guarantee of any outcome. All AI output is probabilistic and can be inaccurate, incomplete, or wrong. You are solely responsible for any betting decisions you make based on — or in spite of — information obtained from the Service.

2. Eligibility

You may use the Service only if all of the following are true:

• You are at least 18 years of age (or the minimum legal gambling age in your jurisdiction, whichever is higher — in several U.S. states that age is 21).
• You have the legal capacity to enter into a binding contract under the laws that apply to you.
• You are not located in, and are not a resident of, a jurisdiction where sports-betting information, analysis, or the purchase of related subscriptions is prohibited.
• You are not on any government sanctions list and have not previously been suspended or removed from the Service.

You are responsible for knowing and complying with the laws of your own jurisdiction. If operating the Service is unlawful for you, you must stop using it.

3. Accounts and Access

Access to AlwaysWager is invite-only. Accounts are created manually by an administrator. You agree to:

• Provide accurate information and keep your account details up to date.
• Keep your password confidential and not share your account with anyone. One account per person.
• Notify us immediately at [email protected] if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We may suspend or terminate your account at any time, with or without notice, for any breach of these Terms or for any conduct that we deem harmful to the Service or other users.

4. Subscriptions and Payments

The Service is offered on paid subscription tiers (currently "Pro" and "Max"). By subscribing, you agree to pay the applicable fees disclosed at the time of purchase. Unless stated otherwise:

• Subscriptions renew automatically each billing cycle until cancelled.
• Fees are non-refundable except where required by applicable law.
• Each tier includes a monthly usage cap on AI compute. If you reach the cap, AI responses will be paused until your cycle renews or you upgrade.
• We may change pricing, features, or caps at any time; changes apply to the next billing cycle and will be communicated in advance.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of sports-betting laws in your jurisdiction.
• Scrape, mirror, resell, or redistribute AI output or platform data, or use them to train competing models.
• Reverse-engineer, attempt to extract source code, bypass rate limits, usage caps, or security controls, or probe the Service for vulnerabilities without written permission.
• Submit malware, attempt to inject prompts that elicit harmful output, or use the Service to harass, defame, or target any person.
• Use the Service to place, broker, or facilitate wagers on behalf of other people (including fixed-match schemes, bookmaking, or any form of illegal gambling operation).
• Share your credentials with any other person or automate interactions with the Service in a way not expressly permitted.

6. AI Output, Accuracy, and No Advice

The AI models that power AlwaysWager produce statistical and probabilistic suggestions. These outputs:

• May be incorrect, out of date, or fabricated(a phenomenon commonly called "hallucination").
• Are not financial, investment, legal, medical, or tax advice.
• Do not guarantee any sporting outcome, win rate, return on investment, or profit. Historical performance does not predict future results.

You must independently verify any information before acting on it. Your betting decisions are your own.

7. Intellectual Property

The Service, its design, code, branding, and content (excluding your own inputs and any third-party content) are owned by AlwaysWager or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

You retain ownership of the content you submit (e.g., chat messages, uploaded images, avatars). You grant us a worldwide, royalty-free license to host, process, and display your content strictly to operate the Service for you and to provide AI responses to your requests.

8. Third-Party Services

The Service integrates third-party providers (for example, AI model providers, email relays, and infrastructure). We are not responsible for the availability, terms, or conduct of third-party services. Their own terms and privacy policies may apply to any data they process on our behalf.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. We do not warrant that AI output is accurate, complete, reliable, or suitable for any particular purpose.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALWAYSWAGER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST WAGERS, LOST OPPORTUNITIES, LOST DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

You specifically understand and agree that we are not responsible for any money you lose through betting activity, whether or not you used information from the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless AlwaysWager and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service and request account deletion at any time by contacting [email protected]. When you do, all associated data — including logs, uploaded images, avatars, and conversation history — will be permanently deleted, subject to any minimal retention we are legally required to keep.

We may suspend or terminate your access at any time for any breach of these Terms. Sections that by their nature should survive termination (including Sections 6, 7, 9, 10, 11, and 13) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws applicable at AlwaysWager's principal place of operation, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by good-faith negotiation first, and then, if necessary, by the competent courts in that jurisdiction, unless a different forum is required by mandatory consumer-protection law where you reside.

14. Changes to the Service or Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top and give reasonable notice (for example, via email or an in-app notice). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
